Medicaid and CHIPs Providers Alert! 2023 Texas legislation may affect your clinic operation. The legislation (HB 44 2023) may require an alteration to your policies that require children to be vaccinated as a condition to receiving services from your practice. To avoid violation of the law, your policy will need to contain exceptions to the vaccination requirement. The exceptions apply to individuals who (1) by reason of conscience, including a sincerely held religious belief, observance, or practice, that is incompatible with the administration of the vaccination or immunization; or (2) a recognized medical condition for which the vaccination or immunization is contraindicated.
